If any element of the conditions is held by a competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and conditions and the remainder of the provision in question shall not be affected.
Performance Clothing attempt to ensure that the information available on the web site at any one time is accurate. However, assume no duty to update such information and Performance Clothiing cannot guarantee that it will be fault-free.

Ordering
Performance Clothing aim to delivery the goods within 28 working days from date of order unless notified on product information.

Orders maybe delayed, if products are not available and Performance Clothing will not be responsible for any delays. Customers will be e-mailed regarding any possible delay and given the option of cancelling the order.

Quoted delivery times are specific to products and locations and apply to working days only. Performance Clothing reserves the right to refuse or remove items from sale or alter their specification without prior notice.

Performance Clothing will issue each order with a number If you are e-mailing Performance Clothing regarding the delay or confirmation of your order, please quote the order number, date of the order and your full name. This will ensure we can trace your order and respond without delay.

Performance Clothing will send an automatic e-mail to confirm your order details.

The quantity and description of the goods shall be those set out in the invoice.

Where any valid claim is notified to Performance Clothing in accordance with these terms and conditions, shall be entitled to replace the goods (or the part in question) free of charge or at Performance Clothing sole discretion, refund to the customer the price of the goods (or proportionate part of the price) but Performance Clothing shall have no further liability to the customer.

It is the responsibility of the consumer to pay for duty within the country of delivery. Performance Clothing will not accept any responsibility for unpaid duty on any orders sent. Only payment for goods and delivery charge have been charged on the customers invoice.

Title, risk of damage to or loss of the goods shall pass to the customer as from the date of despatch from the Performance Clothing Store.

Refunds & Exchanges
Performance Clothing can't be held responsible for incorrect sizes ordered by customers. Performance Clothing are happy to exchange incorrectly ordered products, but additional shipping charges maybe applied before goods are despatched.

Goods will only be accepted, if returned as purchased and in the original packaging.
Performance Clothing aim to supply the highest quality of product and designs. If any product is found to be faulty this should be returned to the address detailed in the fulfilment section ensuring this is despatched to the company applicable to your order each return will be evaluated and if found to be faulty a replacement or refund will be offered.

Please enclose full order details and product fault to ensure your query can be rectified without delay.

This does not affect your statutory rights.

Products
Performance Clothing reserves the right to make any changes in the specification of the goods which are required to conform with any applicable safety or statutory requirements or which do not materially affect the goods' quality or performance as part of a policy of continuous improvement.

Payment
Payment can only be accepted by credit cards placed on the website or in exceptional circumstances a bank transfer or sterling cheque may be arranged.

Any discrepancies should be e-mailed to Performance Clothing immediately and will be rectified if found to be valid.

A copy of your invoice will be despatched with the goods ordered.
A copy of your credit card slip and invoice will be posted to your address.
